These Terms of Service ("Terms") govern your use of the games and applications (each, an "App") provided by Coleskie ("we," "us," or "our"), including our Discord Activity "TicTacToe." Coleskie is an independent project operated by an individual developer. By accessing or using an App, you agree to these Terms. If you do not agree, please do not use the App.
To use our Apps you must meet the minimum age requirements of Discord and any other platform through which you access the App, and you must comply with those platforms' terms. Our Apps are intended for general audiences and are not directed to children under 13.
We grant you a personal, non-exclusive, non-transferable, revocable license to use our Apps for your own personal, non-commercial entertainment, subject to these Terms. We reserve all rights not expressly granted.
When using our Apps, you agree not to:
Information displayed during gameplay, such as your display name and avatar, comes from your Discord account. You are responsible for ensuring that the account information you present through the App is appropriate and complies with applicable platform rules.
Our Apps are provided free of charge and may be modified, suspended, or discontinued at any time without notice. We rely on third-party services (including Discord and our hosting provider) and cannot guarantee that the App will always be available, uninterrupted, or error-free.
Our Apps run within and depend on Discord and other third-party services. Your use of those services is governed by their own terms and policies. We are not responsible for third-party services.
The Apps are provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Apps will meet your requirements or be error-free.
To the fullest extent permitted by law, Coleskie and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of (or inability to use) the Apps. Because the Apps are provided free of charge, our total liability for any claim relating to the Apps is limited to the amount you paid to use them, which is zero.
You agree to indemnify and hold harmless Coleskie and its operator from any claims, damages, or expenses arising out of your misuse of the Apps or your violation of these Terms.
These Terms shall be governed by and construed in accordance with the laws of Washington State / USA, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Washington State / USA, and you hereby consent to personal jurisdiction and venue there.
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of an App after changes take effect constitutes acceptance of the updated Terms.
